Terms of Service

These terms explain the responsibilities that come with using Postmind to create, approve, schedule, and publish social content.

Effective July 9, 2026

1. Agreement and eligibility

These Terms of Service (“Terms”) are an agreement between Postmind, Inc. (“Postmind,” “we,” “us,” or “our”) and the person or organization using postmind.ai and the related Postmind services (the “Service”). By creating an account or using the Service, you agree to these Terms and our Privacy Policy.

You must be at least 18 years old and able to enter a binding agreement. If you use the Service for an organization, you confirm that you have authority to bind it. “You” then means both you and that organization.

2. The Service

Postmind provides tools for brand planning, content creation, collaboration, approvals, AI-assisted work, scheduling, publishing, and related reporting. We may improve, add, remove, or change features over time. We will give reasonable notice when a change materially reduces paid functionality, unless immediate action is needed for security, law, or a third-party service.

3. Accounts and workspaces

Keep account credentials and client review links secure. You are responsible for activity by people you authorize, for assigning appropriate workspace roles, and for promptly removing access that is no longer needed. Information supplied to Postmind must be accurate and current.

The organization that controls a workspace controls its content, connected accounts, membership, and settings. Workspace owners and administrators may access, change, export, or delete content and may suspend another member's access.

4. Publishing, automations, and AI output

Connecting a social account and confirming a publish instruction authorizes Postmind and its publishing providers to send the selected content to that account. The Service may also act on schedules, recurring rules, or other automated instructions that an authorized workspace member enables.

You are responsible for reviewing AI output, content, links, media, claims, audiences, connected accounts, and timing before approving, scheduling, or publishing. AI output may be incomplete, inaccurate, offensive, or similar to content produced for others. It is not professional, legal, medical, or financial advice.

Social networks and their APIs may reject, delay, modify, or remove a post. Postmind does not guarantee delivery at an exact time. When the Service marks a post for manual handling, you remain responsible for completing that step.

5. Your content and permissions

You retain ownership of the text, media, brand materials, instructions, and other content you submit to the Service (“Content”). You grant Postmind a non-exclusive, worldwide, royalty-free license to host, copy, format, process, transmit, and display Content only as reasonably necessary to provide, secure, maintain, and support the Service and follow your instructions.

This license does not transfer ownership of Content or permit Postmind to train its own models on customer Content. It ends when the Content is deleted, except for limited backup, security, legal, and recordkeeping copies.

You confirm that you have the rights and permissions needed for Content, connected accounts, audiences, personal information, music, trademarks, endorsements, promotions, and claims you use through the Service.

6. Connected services

The Service connects with social networks and providers including Bundle.social, Supabase, Vercel, AI model providers, Krea, Resend, and Polar. Their services are governed by their own terms and policies. You must comply with the rules of each social network and connected service you use.

We are not responsible for a third party's service, content, policy, outage, account action, or API change. Disconnecting a social account stops future access through that connection, but you should also cancel any scheduled posts you no longer want sent.

7. Subscriptions, fees, and credits

Prices, plan limits, billing periods, and taxes are shown at checkout. A paid subscription renews automatically for the same billing period until canceled. You may cancel future renewal through billing settings. Cancellation takes effect at the end of the current paid period unless the checkout terms or law require otherwise. Fees are non-refundable except where required by law or expressly stated at purchase.

Plans may include Mind credits for AI work. Included credits reset on the billing cycle shown for the plan. Purchased top-up credits do not expire while the account remains open, but credits are not money, cannot be transferred, and cannot be redeemed for cash. AI generation may pause when available credits are exhausted; scheduling and publishing do not consume Mind credits.

We may change prices or plan limits prospectively. We will provide advance notice of changes that affect an existing paid subscription, and the new terms will apply at a later renewal unless law requires a different process.

8. Acceptable use

You may not use the Service to:

  • break the law or another person's rights;
  • publish deceptive, fraudulent, defamatory, harassing, hateful, exploitative, or unlawfully discriminatory content;
  • send spam, coordinate artificial engagement, impersonate another person, or misrepresent the source of content;
  • upload malware, probe security, evade limits, scrape the Service, or access an account or workspace without permission;
  • use AI output or automated publishing without the review, disclosures, permissions, or human oversight required by law or a connected network; or
  • resell or provide the Service to others except through a plan or written agreement that permits it.

9. Postmind intellectual property

Postmind and its licensors own the Service, including its software, design, documentation, trademarks, and other materials, excluding your Content. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service during your account term under these Terms.

If you provide feedback, you allow us to use it without restriction or compensation, but you do not have to provide feedback.

10. Confidentiality and security

We handle nonpublic workspace Content as described in the Privacy Policy and disclose it only to provide the Service, follow authorized instructions, work with service providers, protect the Service, or comply with law. We use reasonable safeguards designed to protect the Service, but no system is completely secure. You are responsible for suitable backups of Content that is important to you.

11. Suspension and termination

You may stop using the Service at any time. You may delete or request deletion of an account, subject to an organization's control of its workspace and any required retention. Ending an account does not cancel fees already incurred.

We may limit, suspend, or terminate access when we reasonably believe there is a security risk, unlawful activity, material breach of these Terms, unpaid amount, harm to the Service or others, or a requirement from law or a connected provider. Where practical, we will give notice and a chance to resolve the issue.

12. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available.” Postmind disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and quiet enjoyment.

We do not warrant that the Service, AI output, analytics, connected networks, or publishing delivery will be accurate, uninterrupted, secure, or error-free. These disclaimers do not limit a warranty or right that cannot lawfully be excluded.

13. Limitation of liability

To the fullest extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, data, or business opportunity, arising from the Service, even if advised that such damage was possible.

To the fullest extent permitted by law, Postmind's total liability for all claims arising from the Service will not exceed the greater of US $100 or the amount you paid Postmind for the Service during the 12 months before the event giving rise to the claim. These limits do not apply where liability cannot be limited by law.

14. Indemnity

To the extent permitted by law, you will defend and indemnify Postmind and its personnel against third-party claims, losses, and reasonable costs arising from your Content, your connected accounts, your violation of these Terms, or your violation of another person's rights. This does not apply to the extent a claim was caused by Postmind's own breach, negligence, or willful misconduct.

15. Changes and general terms

We may update these Terms. We will post the revised Terms with a new effective date and provide additional notice of material changes when required. Continued use after the updated Terms take effect means you accept them; if you do not, you should stop using the Service before that date.

These Terms, the Privacy Policy, and any order terms are the entire agreement about the Service. If one provision is unenforceable, the rest remain in effect. A failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; Postmind may assign them as part of a merger, reorganization, financing, or sale of the business.
